1. General Provisions

1.1. These Terms and Conditions set out the rules for using the online store available at drawelia.pl and the rules governing the processing of orders placed through the store.

1.3. Drawelia.pl operates as a dropshipping-based distribution business, providing Customers with access to a wide range of products offered by third-party suppliers, primarily from China, without the Store having to maintain physical inventory.

1.4. Products offered through the Store are shipped directly from suppliers to Customers. By placing an order, the Customer becomes the importer of the goods and is responsible for all customs formalities and taxes related to the importation of the goods, in accordance with applicable laws, unless the supplier uses the IOSS (Import One Stop Shop) system, in which case VAT is collected as part of the product price. The Store does not make customs declarations or act as the Customer's customs representative.

1.5. The sale of goods by the Store is not subject to VAT taxation in Poland, and the place of taxation is a third country (primarily China), in accordance with applicable tax regulations, unless the supplier uses the IOSS system. In such a case, VAT is included in the product price and remitted by the supplier to the relevant tax authority in the European Union. Before the Customer places an order, the Store will clearly indicate in a visible location on the website (e.g. in the shopping cart) whether the price includes VAT settled through IOSS or whether the Customer is responsible for settling VAT and any applicable customs charges with the customs authorities.

1.6. The Store cooperates with international suppliers and logistics partners to fulfill orders.

1.7. The Store reserves the right to restrict the availability of its products for certain groups of Customers or regions. Customers will be informed of such restrictions before placing an order.

1.8. Drawelia.pl is not the manufacturer of the products offered through the Store. Responsibility for the products' compliance with applicable laws, including any potential infringement of intellectual property rights (such as patents, industrial designs, or trademarks), lies solely with the manufacturer or supplier. The Store makes reasonable efforts to ensure that it does not offer products that infringe third-party rights and, upon receiving a credible infringement report, will promptly remove such products from its offer.

2. Order Fulfillment

2.1. Products available through the Store are offered based on cooperation with international suppliers, particularly suppliers located in China.

2.2. After the Customer places an order and full payment has been received, the Store forwards the order to the relevant supplier, who prepares the product and ships it directly to the Customer. Orders that remain unpaid for 3 business days may be cancelled by the Store.

2.3. The Store's order processing time is up to 7 business days, starting on the day following the day on which payment is recorded. The final delivery time depends on the supplier and the Customer's location and may range from 10 to 45 business days, which the Customer accepts by placing an order.

2.4. The Store shall not be liable for delivery delays resulting from circumstances beyond its reasonable control, including actions of suppliers, logistics partners, transportation delays, customs inspections, force majeure events, or an incorrect address provided by the Customer.

2.5. If delivery is delayed for more than 45 business days from the date the order is forwarded to the supplier, the Customer has the right to withdraw from the contract and receive a refund of the amounts paid, provided that the Customer submits such a request in writing to draweliashop@gmail.com within 7 days after the expiry of the above-mentioned period.

3. Purchase of Products

3.1. By placing an order, the Customer enters into a sales contract with Drawelia.pl under the terms set out in these Terms and Conditions.

3.2. The Store reserves the right to refuse to fulfill an order in the event of:

  • technical errors on the Store's website,

  • errors in product descriptions or prices,

  • inability to fulfill the order due to the product being unavailable from the supplier,

  • suspected violation of these Terms and Conditions by the Customer.

3.3. Product prices displayed on the Store's website are gross prices and include VAT where the supplier uses the IOSS system. Where IOSS does not apply, prices do not include VAT or customs charges for which the Customer is responsible as the importer. The Store will clearly provide information regarding the VAT settlement method and any potential additional customs costs in a visible location (e.g. in the shopping cart) before the order is placed.

3.4. The Store reserves the right to change product prices without prior notice. Price changes do not apply to orders that have already been placed and paid for.

4. Store Liability

4.1. The Store makes reasonable efforts to ensure that product information is accurate and kept up to date.

4.2. The Store shall not be liable for changes in product availability after an order has been placed by the Customer if such changes result from actions or circumstances involving suppliers.

4.3. The Store shall not be liable for delivery delays resulting from circumstances attributable to the supplier, logistics operator, or Customer.

4.4. The Store shall not be responsible for the quality of products supplied by third-party suppliers; however, it undertakes to assist Customers with the complaint process in accordance with applicable laws, including the General Product Safety Regulation (GPSR).

4.5. The Store shall not be liable for third-party claims relating to intellectual property rights infringement where such claims do not result from the Store's gross negligence or deliberate infringement of such rights. Any such claims should be directed to the manufacturer or supplier of the product.

5. Customer Data and Privacy Policy

5.1. Customers' personal data is processed solely for the purpose of fulfilling orders and in accordance with applicable data protection laws, including the General Data Protection Regulation (GDPR), where applicable.

5.2. In order to fulfill an order, Customer data may be transferred to cooperating entities, including suppliers, logistics partners, or payment processors. By placing an order, the Customer consents to such transfer to the extent necessary to fulfill the order.

5.3. Detailed information regarding the processing of personal data can be found in the Privacy Policy available on the Store's website.

6. Product Safety (GPSR)

6.1. All products offered through the Store are intended to comply with applicable product safety requirements and bear the CE marking where required by applicable law.

6.2. If a product is determined to pose a safety risk, the Store will withdraw the product from the market and notify Customers by email regarding the return procedure. Further details are provided in the Returns & Refund Policy.

6.3. Product safety reports should be submitted to draweliashop@gmail.com. The Store will respond within 24 hours and take appropriate action in accordance with applicable product safety regulations.

6.4. Customers are required to follow the instructions for use provided with the products by the suppliers in order to ensure safe use of the products.

7. Complaints and Returns

7.1. If the Customer receives a defective product, the Customer has the right to submit a complaint in accordance with applicable consumer protection laws.

7.2. A complaint should be submitted promptly after the defect is discovered and, where applicable, within 2 years from the date of delivery of the product, by email to draweliashop@gmail.com.

7.3. A complaint should include the order number, a description of the defect, the Customer's contact details, and photographs of the defect, where applicable. Return shipping costs related to a complaint shall be borne by the Customer unless the Store determines otherwise or applicable law requires otherwise.

7.4. Complaints will be reviewed within 14 business days of receiving a complete complaint. If it is necessary to contact the supplier, the processing time may be extended to up to 30 business days, and the Customer will be informed accordingly.

7.5. A Customer who is a consumer has the right to withdraw from the contract within 14 days of receiving the product without providing a reason, where required by applicable consumer protection laws. Details of the withdrawal procedure are provided in the Returns & Refund Policy available on drawelia.pl.

8. Final Provisions

8.1. The Store reserves the right to amend these Terms and Conditions at any time. The current version of the Terms and Conditions is available on the website. Changes will not affect orders placed before the changes take effect.

8.2. By placing an order through the Store, the Customer accepts these Terms and Conditions.

8.3. Any disputes arising from sales contracts shall be resolved by the court having jurisdiction over the Store's registered office, unless applicable law provides otherwise.
